PRIVACY POLICY

This Privacy Statement is effective as of January 2019.

PLEASE READ THIS CAREFULLY AS THIS POLICY IS LEGALLY BINDING WHEN YOU USE MODELPORT.

Day8 Design Ltd (We), the developer and owner of ModelPort (Service), recognize the importance of protecting your personal information and are committed to processing it responsibly and in compliance with applicable data protection laws.

This Privacy Statement describes our general privacy practices that apply to personal information we collect, use and share about consumers and other individuals within our business partners.

For the purpose of the relevant data protection regulations, Day8 Design Ltd are the data controller of your information. We are located in Hungary, 1014 Budapest Tarnok street 22-24. If you have any questions about how we protect or use your data, please email us at modelport@day8.hu.

Why and how we collect and use your personal information

We may collect and use your personal information as an individual for various purposes, such as the following:
Licensing your ModelPort: When you subscribe for a ModelPort license we bind your license to your computer or your ARCHICAD license. To do this we always collect your computers host ID and in case you would like to bind ModelPort to your ARCHICAD license, we collect your ARCHICAD license information as well. From time to time we check this information to prevent abuse of licensing.
Customer support: When you contact us in connection with a request for information, to order a licence, to provide you with support, we collect information necessary to fulfill your request, to grant you access to the product or service, to provide you with support and to be able to contact you. We collect your name and contact information, details about your request and your agreement with us and the fulfillment, delivery and invoicing of your order and we may include client satisfaction survey information. We retain such information for administrative purposes, defending our rights, and in connection with our relationship with you.
Marketing: When visiting our websites or using ModelPort we may provide you with personalized information. You can always opt-out from receiving personalized communication by sending an e-mail.
For safety and security: We use information about you and your ModelPort use to verify accounts and activity, to monitor suspicious or fraudulent activity and to identify violations of ModelPort policies.
To protect our legitimate business interests and legal rights:Where required by law or where we believe it is necessary to protect our legal rights, interests and the interests of others, we use information about you in connection with legal claims, compliance, regulatory, and audit functions, and disclosures in connection with the acquisition, merger or sale of a business.
With your consent: We collect and use information about you where you have given us consent to do so for a specific purpose not listed above. For example, we may publish testimonials or featured customer stories to promote ModelPort, with your permission.

If you have consented to our use of information about you for a specific purpose, you have the right to change your mind at any time, but this will not affect any processing that has already taken place. Where we are using your information because we or a third party (e.g. your employer) have a legitimate interest to do so, you have the right to object to that use though, in some cases, this may mean no longer using the Services.

Information we collect when you download ModelPort
Your email address (if available), IP address of the computer you use for downloading ModelPort, the version number of ModelPort that you download, date and time of the download.

Information we collect when you purchase a licence
Your full name and email address, your licence key and licence type, date and time of the purchase.

Information we collect when you activate and use ModelPort
IP address, Host ID, current user name and the operating system of the computer you use for activating ModelPort on, ARCHICAD version and ARCHICAD license key (if available), date and time of the activation.


Sharing of Personal Information
Where appropriate, we may also share your personal information with selected partners to help us provide you, or the company you work for, products or services, or to fulfill your requests, or with your consent. When selecting our suppliers and partners, we take into account their data handling processes.

Please be aware that in certain circumstances, personal information may be subject to disclosure to government agencies pursuant to judicial proceeding, court order, or legal process. We may also share your personal information to protect our rights or property, our business partners, suppliers or clients, and others when we have reasonable grounds to believe that such rights or property have been or could be affected.

International transfers of information we collect
We collect information globally and primarily store that information in Hungary. We transfer, process and store your information outside of your country of residence, to wherever we or our third-party service providers operate for the purpose of providing you the Services. Whenever we transfer your information, we take steps to protect it.

Sharing your data outside of the EEA
In order to provide our Services to you, it is sometimes necessary for us to transfer your data to the third parties that are based outside of the European Economic Area. In these cases, we ensure that both ourselves and our partners take adequate and appropriate technical, physical and organisational security measures to protect your data. We also ensure we have appropriate contractual protections in place with these third parties.

Information Storage, Security and Accuracy
We intend to protect your personal information and to maintain its accuracy. We use data hosting service providers in Hungary to host the information we collect, and we use technical measures to secure your data. While we implement reasonable safeguards designed to protect your information, no security system is impenetrable and due to the inherent nature of the Internet, we cannot guarantee that data, during transmission through the Internet or while stored on our systems or otherwise in our care, is absolutely safe from intrusion by others. We encrypt certain sensitive personal information when we transmit such information over the Internet.

Retention Period
We retain your account information for as long as your account is active and a reasonable period thereafter in case you decide to re-activate the Services. We also retain some of your information as necessary to comply with our legal obligations, to resolve disputes, to enforce our agreements, to support business operations, and to continue to develop and improve our Services. Where we retain information for Service improvement and development, we take steps to eliminate information that directly identifies you, and we only use the information to uncover collective insights about the use of our Services, not to specifically analyze personal characteristics about you.

We may change this privacy policy from time to time. - restrict, suspend or terminate your access to the Services;

Even if the Services are not currently administered to you by an organization, if you use an email address provided by an organization (such as your work email address) to access the Services, then the owner of the domain associated with your email address (e.g. your employer) may assert administrative control over your account and use of the Services at a later date.

If you do not want an administrator to be able to assert control over your account or use of the Services, use your personal email address to register for or access the Services. If an administrator has not already asserted control over your account or access to the Services, you can update the email address associated with your account. Our policy towards children
The Services are not directed to individuals under 16. We do not knowingly collect personal information from children under 16. If we become aware that a child under 16 has provided us with personal information, we will take steps to delete such information.
